PHILIPPINES: Binasura ng Comelec ang 3 Motions to Intervene on Petition vs. Marcos
Na denied nitong Lunes ng Commission on Elections (Comelec) ang three motions to intervene on a petition para kanselahin ang certificate of candidacy (COC) ni presidential aspirant Ferdinand “Bongbong” Marcos Jr.
Sa 13-pahinang kautusan, binasura ng poll body’s Second Division ang motions for intervention na magkahiwalay na inihain ni Rommel Bautista at ng iba pa; Reynaldo Tamayo Jr. at iba pa; at ng Partido Federal ng Pilipinas (PFP) kaugnay ng petisyon na inihain ni Fr. Christian Buenafe at ng iba pa.
“It shall unduly delay or prejudice the adjudication of the rights of the original parties in the case. If the instant Motion for Intervention is granted, this will necessarily result to unduly delaying the resolution of the main petition,” nakasaad sa resolusyong ipinahayag nitong Disyembre 13.
Sinabi rin ng Comelec ang Motion for Intervention na inihain ng grupo ni Bautista, Motions to Intervene and Admit Attached Answers-in-Intervention na inihain ni Tamayo at iba pa, at Motion for Leave to Intervene with Motion to Admit Attached Answer-in-Intervention na inihain ng PFP , ay hindi pinapasok at samakatuwid, “itinuring na mga piraso lamang ng papel.”
Sinabi ng poll body na, si Bautista at ang iba pa ay naghain ng Petition-in-Intervention, 33 araw matapos maghain si Marcos ng kanyang COC, na lampas sa mandatory 25-day period na itinakda sa Section 78 ng Omnibus Election Code (OEC).
“If the Commission (Second Division) shall admit the Tamayo and PFP Motions are considered the same in the resolution of the main case, we would be in effect according to undue advantage to the respondent. Allowing the intervention of Tamayo, et al. and PFP necessarily places respondent on unfairly advantageous position,” idinagdag nito.
Sinabi nito na ang pagpayag sa mga petitioner na makialam ay maaari ring mag-trigger ng iba pang mga intervenor na maghain ng kanilang sariling mga mosyon para sa mga intervention na mangangailangan sa Comelec na lutasin muna ang mga mosyon na ito bago resolbahin ang pangunahing kaso.
Pagkatapos magpasya sa tatlong petisyon, sinabi ng Second Division na hindi na ito aasikasuhin ang mga mosyon sa hinaharap para sa mga intervention at/o mga petitions-in-intervention o answers-in-intervention sa kaso.
Sa kabilang banda, sinabi ni Comelec spokesperson James Jimenez na wala pang desisyon ang Una at Ikalawang Dibisyon First and Second Divisions kung kanilang pagsasama-samahin ang mga kaso upang maiwasan ang conflict sa kanilang mga desisyon sa mga petisyon na inihain laban sa dating senador.
“While there is a possibility that the cases might be consolidated, but so far there is no decision yet, so I guess they have not seen grounds for possible conflict,” dagdag paniya.
Ang iba pang mga petisyon na inihain laban kay Marcos ay mga petisyon para idiskwalipika at ideklara siya bilang isang nuisance candidate.
